Received June 8, 2001 From: Eishi Furukawa This letter is intended to clarify Mitsubishi Electric Corporation's patent licensing policy with respect to our patents and a patent application, PCT/JP96/02154 ("Patents"), which is/are essential to implement the encryption algorithm MISTY1(One). The proposed Patents may cover a certain proposed Internet Engineering Task Force (IETF) as RFC2994 ("Standard"). Mitsubishi Electric Corporation ("Mitsubishi") understands the importance of widespread use of the Standard, and Mitsubishi is willing to offer licenses upon request, as follows: On condition that other company and/or entity shall grant their patents essentially required to IETF standards under fair and commercially reasonable terms and conditions on non-discriminatory basis in accordance with the RFC 2026 policy, Mitsubishi hereby declares that it is prepared to grant, on the basis of reciprocity and non- discriminatory, a royalty-free license under the Patents to an unrestricted number of applicants on a world-wide, with other fair and reasonable terms and conditions to manufacture, use and/or sell implementations of the above RFC2994, provided that, Mitsubishi shall reserve any and all rights to enforce the Patents against any applicant in the event that such applicant asserts any patents related to cryptographic technology which are essential to products having MISTY1 function.
